Types of Child Custody
There are three main types of results a court will give to a parent: sole, primary, and joint custody. A court determines the level of custody for a parent based on the child’s wishes, past nurturing moments, and the well-being (i.e. financial support, physical and mental health) of the child.
Physical custody is when each parent is permitted to a certain amount of time which the child is allowed to be with their parent. This type of child custody can be sole, primary, or joint custody.
Legal custody is where a parent is concerned for the health, education, and welfare of their child. This type of child custody could also be sole, primary, or joint custody.
Under legal custody, the court will determine one legal parent as the primary, giving the other parent temporary custody or visitation rights only. In other cases, a parent can have joint custody, which both parents get shared time with their children.
