DUI Guilty Factors:
Physical Ability: If you are guilty of driving while your ability is affected in the slightest. The jury will determine whether or not you are innocent or guilty.
BAC: Blood Alcohol Content (BAC) determine if the driver was operating a vehicle above or below the legal limit. The current legal limit in Colorado is no more than 0.08 grams of alcohol in 100 milliliters of blood while driving.
Physical Proof: The court will look at physical proof against the person accused of driving while under the influence. Proof includes police reports describing the state of the defendant, such as conscious awareness, bloodshot eyes, slurred speech, slow cognitive skills.
Sobriety Test Results: In most cases, a person stopped on suspicion of a DUI will be asked to do a field sobriety test. This test includes walking in a straight line, a hand-eye coordination test, and simple cognitive tests, such as reciting the alphabet.
